Offer, order and conclusion of contract<\/p>

The offers on www.darynchook.com do not represent binding offers in the legal sense, they are for information purposes only and represent requests for offers by the customer. With his order, the customer makes a binding offer, which can be accepted by the provider through actual compliance or expressly.<\/p>

Availability \/ Scope of delivery<\/p>

If goods ordered by the customer are not in stock after conclusion of the contract, the supplier reserves the right to restore availability within a period of maximum 8 weeks without consequences of default. If availability cannot be restored within this period, the customer may withdraw from the contract in writing. In the event of withdrawal, payments already received by the customer will be refunded immediately.<\/p>

Or if for legal reasons (insolvency of the product manufacturer) the ordered goods are not delivered, the provider reserves the right to withdraw from the contract. In case of withdrawal, payments already received from the customer will be refunded immediately.<\/p>

The scope of delivery always refers to the product description in the text, but not to accessories which may be shown in product illustrations (see also point 4.).<\/p>

Prices<\/p>

All prices shown on www.darynchook.com are final prices including Austrian VAT (currently 20%) in EURO. Shipping costs are not included. The stated prices always refer to the product description in the text, but not to accessories shown on product images. The current prices at the time of ordering apply, no liability is assumed for printing errors in the price information.<\/p>

Payment and payment method<\/p>

Austria and Germany<\/p>

Payment for the goods can be made by credit card, by PayPal or by instant bank transfer:<\/p>

a) by credit card: You pay with your credit card during the checkout process in the webshop. The supplier receives a real-time confirmation of the payment made and can ship the goods immediately.<\/p>

b) via PayPal: You pay during the checkout process in the webshop with your PayPal account. The supplier receives a real-time confirmation of the payment and can ship the goods immediately.<\/p>

c) by instant bank transfer: You pay during the checkout process in the webshop via your online banking account. The provider receives a real-time confirmation of the payment and can ship the goods immediately.<\/p>

The provider reserves the right to not or no longer offer certain payment methods or to offer other payment methods.<\/p>

Delivery and shipping costs<\/p>

The delivery of the goods takes place within 14 working days at the expense and risk of the customer. Delays in delivery may occur in individual cases, in such cases the supplier may execute the customer's order in partial deliveries. Incomplete deliveries or damage to the goods must be reported to the relevant post office within 24 hours. The presentation of the postal confirmation is a prerequisite for a replacement delivery.<\/p>

Right of withdrawal
The customer may withdraw from the concluded contract without giving any reason. The declaration of withdrawal can be made in any form and must be received by the provider within a period of 14 days (weekdays). In the case of written declarations of withdrawal (mail, e-mail, fax, etc.), it is sufficient if the declaration of withdrawal is sent within the 14 days (the date of the outgoing postmark is decisive).
The period for withdrawal begins
1. with the day on which the customer or a third party named by him (in case of a different delivery address) has received the goods;
2. in the event that the Provider fulfills a uniform order in partial deliveries, on the day on which the Customer or a third party designated by the Customer (in the event of a different delivery address) has received the last goods delivered;

Retention of title
Each item remains the property of the provider until full payment of the purchase price. The supplier has the right to assert his rights from the retention of title in case of default of payment. The assertion of the rights from the property does not constitute a withdrawal from the contract, unless the provider at the same time expressly declares the withdrawal from the contract.<\/p>

Warranty
In principle, only the manufacturer's product description shall be deemed agreed as the quality of the goods. At the time of handover, the goods are not defective in any way that would nullify or diminish their value or suitability for normal use. Properties shall only be deemed to be warranted if they are expressly identified as such on www.darynchook.com. The provider assumes no liability for content found on linked pages.<\/p>

Choice of law
Austrian law shall apply to all legal relationships between the supplier and the customer. The contractual, ordering, settlement and business language is exclusively German.<\/p>

Copyright
All offers, including the associated images, text descriptions and graphic designs, as well as the design of the homepage itself, are subject to the copyright of the provider. The linking or use for own purposes is only permitted after prior written consent by the provider.<\/p>

Other
The place of performance for services of the provider and consideration of the customer is the registered office of the provider.
